ORDER
The petitioner has filed this Writ Petition seeking Writ of Mandamus to direct the first respondent to pay the salary for the 138 days of earned leave and 141 days of medical leave to the petitioner.
2. The petitioner has retired from service. His grievance is that his earned leave benefit has not been given to him so far and his representation to release the same is pending. He further submitted that the petitioner had applied 141 days of medical leave and that should also be encashed. But such a benefit in respect of medical leave can be given to the petitioner only if the rules permit. Had the petitioner availed medical leave and for which the salary has not been paid despite he has the leave in his credit, it is possible for the second respondent to sanction the same. If it is the pending medical leave credit in the account of the petitioner, the second respondent cannot sanction the monetary benefits as claimed by him.

3. With this observation, the first respondent is directed to consider the petitioner's request and pass appropriate orders within a reasonable period of two weeks from the date of receipt of a copy of this order. The Writ Petition is disposed of. No costs.
