ORDER : The Court Made the following order :- The petitioner, who is accused No.7 in Crime No.563 of 1997 on the file of the respondent police, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 148, 324, 326, 307, 396, 450, 455, 427, 325 r/w 307, 302, 149 of IPC and Section 3 of Explosive and substances Act, which is now pending in PRC.No.13 of 2004 on the file of the learned Judicial Magistrate Court, Padmanabhapuram, seeks anticipatory bail. 2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent/State. 3.
The learned Additional Public Prosecutor, on instructions, would submit that due to absence of the petitioner, non-bailable warrant was issued against the petitioner by the trial Court on 12.05.2017. He further submitted that the case is pending before https://hcservices.ecourts.gov.
Non-bailable warrant.
4.Considering the fact that non-bailable warrant was issued against the petitioner for his absence, there shall be a direction, directing the petitioner to surrender before the learned Judicial Magistrate Court, Padmanabhapuram and to file a petition for recalling the warrant within 10 days from the date on which the order copy made ready and the learned Judicial Magistrate, is directed to consider the same on the same day and pass orders on merits in accordance with law.
