ORDER

This petition has been filed by the petitioner to direct the second respondent not to harass the petitioner under the guise of enquiry.

2. According to the petitioner, the petitioner's husband was working as staff in one Global Trade Real Estate Company, Trichy and the Company received deposit from the investors and thereafter, due to nonpayment, a case has been registered in Crime No.3 of 2022. While so, for the same set of allegations, another case in Crime No.4 of 2022 also registered. The petitioner's husband also was arrayed as one of the accused in this case and thereafter, he was enlarged on bail. Now, after three years, the second respondent without issuing any summons, compelled the petitioner to attend enquiry and thereby, harassing the petitioner. Hence, she sent a representation, dated 17.03.2025 and the same has not been considered. Hence, the petitioner filed this petition. 2/5

3. The learned Government Advocate (Crl. Side) appearing for the respondents would submit that the petitioner is one of the accused in Crime No. 2 of 2022 on the file of the District Crime Branch, Sivagangai and another case in Crime No.3 of 2022 on the file of the District Crime Branch, Ramanathapuram and all of them have been transferred to Trichy, Economic Offence Wing and now the same is pending before the Economic Offence Wing, Trichy. For investigation purpose, the second respondent called the petitioner but the petitioner did not appear. They have not harassed the petitioner as alleged by her in the petition.

4. Since the prayer of the petitioner is not to harass the petitioner and the second respondent also called the petitioner for investigation purpose and two cases are pending against the petitioner, recording the above said submission of the second respondent, this Criminal Original Petition stands closed. 20.03.2025 NCC : Yes / No Index : Yes / No Internet : Yes BTR 3/5
