The Criminal Original Petition has been filed for a direction to the learned Judicial Magistrate, Aruppukottai to commit the case pending in C.C.No.167 of 2016 to the file of the Assistant Sessions Judge, Aruppukottai to be tried along with S.C.No.215 of 2015 as joint trial and to dispose of both cases in accordance with law.

2. The learned Government Advocate (Crl.side) appearing for the fourth respondent has no serious objection for committing the case in C.C.No.167 of 2016 to the file of the Assistant Sessions https://hcservices.ecourts.gov.in/hcservices/

Judge, Aruppukottai.

3. It is settled Law that this is a case of case in counter, it has to be tried by the same Court. Accordingly, the learned Judicial Magistrate, Aruppukottai is directed to commit the case in C.C.No.167 of 2016 to the file of the Assistant Sessions Judge, Aruppukottai for trial simultaneously with S.C.No.215 of 2015 and the learned Assistant Sessions Judge, Arupukottai is directed to dispose of both the cases on merits in accordance with law, as expeditiously as possible.

4. With the above direction, the Criminal Original Petition is disposed of. Consequently, the connected Miscellaneous Petition is closed.
