PRAYER :- For Bail in Crime No.34 of 2023 on the file of the respondent police ORDER : The Court made the following order :- The petitioner/sole accused, who was arrested and remanded to judicial custody on 19.02.2023 for the offence punishable under Sections 294(b),323,506(i) and 420 of IPC in crime No.34 of 2023 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the defacto complainant got acquaintance with the petitioner herein through cell phone. The petitioner herein informed him that if the complainant invested some money in the share market he will get more profit , hence on 17.08.2022 the petitioner came to the house of the defacto complainant and received a sum of Rs.15 lakhs by cash from the complainant inorder to invest the same in the share market, but the petitioner did not invest the same in the share market and not returned the money. When the defacto complainant urged the petitioner to return the money he abused him in filthy language and also criminally intimidated him, hence the case. https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.5554 of 2023 3.Heard both sides and perused the materials available on record including the First Information Report. 4.There are totally 10 accused in this case and the petitioner herein is arrayed as A1. The modus operandi of the accused person is that he used to collect money from the general public and invest the same in the share market. He has so far collected more than Rs.5 Crores from the general public and the respondent are receiving more than 50 complaint from the victim and they are about to transfer the complaint to Economic Offences Wing. The petitioner is the mastermind behind the entire crime and he has cheated the general public through bank transaction. Further if the petitioner is released on bail, he will abscond and tamper with evidence and hamper with the investigation, hence this Court is not inclined to grant bail to the petitioner.

5.Hence the petition stands dismissed.
