Respondents PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C. praying to direct the first respondent police to withdraw the Look Out circular as against the petitioner in connection with the Crime No.4 of 2015 on the file of the 2nd respondent police and consequently direct the 1st respondent to communicate the order of lifting of travel restriction imposed in pursuant to above said Look Out Circular to the immigration offices. ORDER

It is an application seeking a direction to the first respondent police to withdraw the Look Out circular as against the petitioner in connection with the Crime No.4 of 2015 on the file of the 2nd respondent police and consequently direct the 1st respondent to communicate the order of lifting of travel restriction imposed in pursuant to above said Look Out Circular to the immigration offices.

2. Mr.D.Ramesh Kumar, learned counsel for the petitioner would submit that due to matrimonial dispute, a case in Crime No.4 of 2015, was registered against the petitioner, on the file of the https://hcservices.ecourts.gov.in/hcservices/

second respondent. Subsequently, the First Information Report was quashed by this Court in Crl.O.P.(MD).No.6487 of 2016 on 15.04.2016. It is further submitted that during the investigation in the above said Crime No.4 of 2015, the Look Out Circular was issued by the Superintendent of Police and after the First Information Report was quashed, the respondent police have not sent any intimation to the Immigration Office, therefore the petitioner was detained in the Airport at Mumbai. Hence, the present petition is filed.

3. The learned Government Advocate (Crl. Side) has produced a letter of the Superintendent of Police, Pudukkottai District, dated 29.04.2016, thereby the first respondent has informed to the Foreigners Regional Registration Office, Bureau of Immigration, Ministry of Home Affairs, Government of India, about the withdrawal of the Look Out Circular, issued against the petitioner bearing Passport No.F-8974299.

4. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) for the respondents.
