PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent to issue a passport to the petitioner pending on his file in reference No.MD2076493759724 dated 26.04.2024 forthwith or any reasonable time that this Court may be fixed for the disposal of the petitioner passport application, awards cost. 1/4

ORDER

The present writ petition has been filed seeking a mandamus directing the first respondent to issue the passport to the writ petitioner based upon his application dated 26.04.2024.

2. The learned Government Advocate(crl.side) appearing for the second respondent brought to the notice of the Court that a charge sheet has been laid as against the writ petitioner in C.C.No.213 of 2015 on the file of the Judicial Magistrate No.I, Tirunelveli, on 27.07.2015.

3. In view of the above said facts, the petitioner is directed to approach the trial Court concerned seeking the permission of the Court to go abroad. In case, any such application is filed, the trial Court is directed to dispose of the same within a period of four weeks. Based upon the order to be passed by the concerned trial Court, the first respondent is directed to proceed in accordance with law.

4. With the above said observations, this writ petition stands disposed of. No costs.
