PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, 2023, for a direction, direct the 1st Respondent instruct the Respondents 2 to 5 not to harass the Petitioner and her family members in any manner and to ensure that the Petitioner is allowed to life peacefully in the Sri Lankan Tamil Rehabilitation Camp situated at Thappathi Village, Ettayapuram Taluk, Thoothukudi District without any interference. For Petitioner : M/s.V.Selvakumar For Respondents : Mr.A.Albert James Government Advocate(crl.side) for R1 to R3

ORDER

The present petition has been filed seeking a direction to the first respondent to instruct the respondents 2 to 5 not to harass the petitioner and her family members and to ensure that the petitioner is allowed to live peacefully in the Srilankan Tamil Rehabilitation Camp situated at Thappathi Village, Ettayappan Taluk, Tuticorin District.

2. According to the learned Counsel appearing for the petitioner, he has lodged a complaint as against one Jagan on 24.02.2026 alleging that he has encroached upon the property. On the said complaint, the 5th respondent is alleged to have pressurised the petitioner to withdraw the complaint as against the said Jagan. Therefore, the present petition has been filed. 2/5

According to the learned Government Advocate(crl.side) appearing for the respondents 1 to 3, the complaint lodged by the petitioner relates to encroachment made by Jagan into the pathway of the petitioner and therefore, the said complaint has been forwarded to the third respondent for proper enquiry. He further submits that the police officials have not pressurised the petitioner to withdraw the complaint and the complaint is now pending before the third respondent.

4. In view of the above said facts, the third respondent is directed to complete the enquiry within a period of two weeks from the date of receipt of a copy of this order.

5. With the above said observations, this Criminal Original Petition stands disposed of.
