O R D E R

The petitioner is before this Court seeking issuance of a Writ of Mandamus to forbear the respondents from forming a road in the petitioner's property in Survey No.177/2A, to an extent of 0.3.00 Ares, situated at P. Muthuramalingapuram Village, Kamuthi Taluk, Ramanathapuram District.

2. The petitioner has also filed a suit for declaration and permanent injunction against the respondents herein before the jurisdictional civil Court. In the said suit, the defendants had filed a written statement stating that they do not intend to form a road in the subject property. However, according to the petitioner, the third respondent is now attempting to form a road in the subject property forcibly without following due process of law.

3. Mr. S. Kameswaran, learned Government Advocate, who accepted notice on behalf of the respondents, placed on record certain photographs to indicate that the road has already been formed.

4. In view of the above development, the relief sought for by the petitioner in this Writ Petition does not survive for further consideration. Therefore, the Writ Petition is disposed of, preserving liberty to the petitioner to seek appropriate relief by making necessary amendments in the pending suit before the jurisdictional civil Court, including a prayer for mandatory injunction. No costs. Consequently, the connected miscellaneous petition is closed.
