Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the first respondent to dispose the Patta Appeal dated 18.05.2020 on the file of the first respondent within time frame fixed by this Court.

ORDER

This Writ Petition has been filed for a Mandamus seeking for a limited relief of early disposal of the petitioner's statutory appeal filed before the first respondent under the Patta Passbook Act.

2. Aggrieved by the issuance of patta in favour of the second respondent, the petitioner has filed a statutory appeal before the first respondent on 18.05.2020. The petitioner seeks for early disposal of the same.

3. No prejudice would be caused to the respondents, if the statutory appeal filed by the petitioner is disposed of expeditiously after affording a fair hearing to the petitioner as well as the second respondent and any other necessary party, whom the first respondent deems fit to enquire.

4. For the foregoing reasons, this Court directs the first respondent to dispose of the statutory appeal filed by the petitioner on 18.05.2020 pertaining to Patta No.1208 and pass final orders on merits and in accordance with law, after affording a fair https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD).No.7315 of 2022 hearing to the petitioner as well as the second respondent and any other necessary party, whom the first respondent deems fit to enquire, within a period of four (4) months from the date of receipt of a copy of this order.

5. With the aforesaid direction, this Writ Petition is disposed of. There shall be no order as to costs.
