Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of CERTIORARIFIED MANDAMUS to call for the records from the office of the 2nd respondent with respect to File No.2026/0103/24/007483 dated 16-02-2026 and quash the same and consequently direct the respondents to subdivide the land of the petitioner to an extent of 1256.25 sq.ft.., situated in S.Nos. 40/7A1A,comprised in Patta No.2477, Narasingam Bit IV, Madurai East Taluk, Madurai District and issue separate Patta on the basis of petitioner's sale deed dated 15-12-2025.
ORDER
The present Writ Petition has been filed for the issuance of a Writ of CERTIORARIFIED MANDAMUS to quash the File No.2026/0103/24/007483 dated 16-02-2026 and consequently, to direct the respondents to sub-divide the land of the
petitioner to an extent of 1256.25 sq.ft.., situated in S.Nos.40/7A1A,comprised in Patta No.2477, Narasingam Bit IV, Madurai East Taluk, Madurai District and issue separate Patta on the basis of petitioner's sale deed dated 15-12-2025. 2.The petitioner has purchased the plot through Document No.5169 of 2025 dated 15.12.2025 from an approved layout. The petitioner has submitted an application to the Tahsildar. The petitioner is relying on the application which would be submitted along with the sale deed in which it has been stated that the patta can be transferred and separate application need not be submitted. 3.The respondent had stated that the petitioner had submitted to the Village Administrative Officer. But the Village Administrative Officer is not a competent authority to issue patta.
Further, the petitioner ought to submit an online application for transfer of patta after paying a requisite fee. 4.Therefore, the petitioner is directed to submit a fresh online application to the first respondent after paying requisite fee forthwith. Once the same is submitted, the Tahsildar is directed to issue patta considering the sale deed and transfer of patta application which is annexed along with the sale deed. The said exercise shall be completed within a period of six weeks from the date of receipt of a copy of this order.
5.With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
