CMP(MD) No.4382 of 2023 ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S J.S.MURALI, Advocate for the petitioner and of M/S.L.VELPRADEEP, Advocate on behalf of the Respondents the court made the following order:- [Order of the Court was made by R.SUBRAMANIAN, J.] Mr.I.Velpradeep, learned counsel takes notice for the respondents 1 to 4/claimants.
2. There will be stay on condition that the petitioner deposits a sum of Rs.50,00,000/-(Rupees Fifty Lakhs Only) with proportionate interest, to the credit of M.C.O.P.No.196 of 2018 on the file of the Motor Accident Claims Tribunal, Principal District Court, Karur, within a period of six weeks from the date of receipt of a copy of this order.
3. On such deposit, the wife of the deceased namely the first respondent is permitted to withdraw a sum of Rs.25,00,000/-(Rupees Twenty Five Lakhs Only) with proportionate interest. The remaining amount shall be kept in any one of the nationalised banks in an interest earning fixed deposit, initially for a period of two years with an auto-renewal clause.
