Petitioners/A1 & A2 Vs The State Rep.by The Inspector of Police, Senthamaram Police Station, Tenkasi District.

(Crime No.345 of 2022) ... Respondent/Complainant For Petitioners : Mr.P.Rajesh Advocate.

For Respondent : Mr.R.M.Anbunithi, Additional Public Prosecutor.

PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.345 of 2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioners/A1 & A2, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 468, 469, 471 IPC in Crime No.345 of 2022, seek anticipatory bail. 2.The case of the prosecution is that the defacto complainant is a President of Ariyanayagipuram. The petitioners illegally created a forged letter with fabricated seal and sign and obtained permission from the District Collector for shifting the TASMAC shop to the defacto complainant's village. Hence the case. 3.Heard both sides and perused the materials available in the record.

CRL OP(MD)No.5655 of 2023 4.It is seen that the petitioners fabricated the Government seal and created no objection certificate as if the same was issued by the defacto complainant, in order to open TASMAC shop. Therefore, custodial interrogation of the petitioners is very much necessary in this case. That apart, earlier petitions also withdrawn by the petitioners and this is third petition for anticipatory bail. Hence, this Court is not inclined to grant anticipatory bail to the petitioners. Accordingly, this criminal original petition is dismissed.
