ORDER : The Court Made the following order :- The petitioner is in judicial custody since 13.09.2018 for the offences punishable under Sections 420, 465, 468, 471, 477(A) I.P.C @ 120(b), 406, 420, 465, 468, 471, 477(A), 409 and 506(i) I.P.C, in Crime No.38 of 2018 on the file of the respondent police. He seeks bail.
2.The case of the prosecution is that the petitioner and other accused persons are alleged to have entered into criminal conspiracy and sole the property in question, which did not belong to A2, to the defacto complainant and also a huge sum of money ie., nearly more than 1.5 crores of rupees has been transferred from the account of the defacto complainant and his wife by using the withdrawal slip of the defacto complainant. The wife of the defacto complainant did not sign any withdrawal slip and gave it to the second accused. Even those withdrawal slips were given for the purpose of registration expenses and construction expenses of compound wall, the wife of the defacto complainant did not give any withdrawal slip. Even then, the second accused has withdrawn Rs.34,51,000/- from the account of the wife of the defacto complainant. Hence, the complaint. https://hcservices.ecourts.gov.in/hcservices/
3.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent. 4.Taking note of the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail subject to the following conditions:
(i) the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Madurai.
(ii)the petitioner shall appear before the respondent police daily at 10.30 a.m. until further orders;
