ORDER

This petition has been filed by the petitioner to direct the first respondent to give suitable directions to the second respondent not to harass the petitioner by interfering in the civil dispute on the guise of enquiry on the false complaint of the third respondent without due process of law.

2. According to the petitioner, there is a dispute between the parties in respect of sale agreement for the immovable property. While so, the third respondent lodged a false complaint against the petitioner before the second respondent for the above said money dispute. Taking advantage of the same, the second respondent called the petitioner frequently for enquiry and the petitioner also appeared for enquiry. In spite of that the second respondent frequently called the petitioner by interfering the civil dispute. Therefore, the petitioner filed this petition.

3. The learned Government Advocate (Crl. Side) appearing for the official respondents would submit that based on the complaint given by the third respondent, they called the petitioner for enquiry and issued summons but the petitioner did not appear for summons. However, the enquiry is still pending and they will complete the enquiry within 15 days.

4. Considering the limited scope of prayer sought for in this petition, this Court even without issuing notice to the third respondent inclined to pass orders in this petition.

5. According to the petitioner, there is a money dispute pending between the petitioner and the third respondent. For this money dispute, the second respondent frequently called the petitioner for enquiry and the second respondent also admitted the complaint lodged by the third respondent as against the petitioner and the same is under enquiry. Therefore, it is for the second respondent to complete the enquiry in accordance with law. It is needless to mention that if the matter is civil in nature, the second respondent 3/6

has to follow the circular issued by the Director General of Police in this regard.

6. In view of the same, this Court directs the second respondent to complete the enquiry within a period of 15 days from the date of this order in accordance with law.

7. With the above said directions, this Criminal Original Petition stands disposed of.
