Criminal Original Petition filed under Section 482 of Cr.P.C, praying to direct the second Respondent to withdraw the case in Crime No.319 of 2021 dated 30/08/2021 on the file of the fourth Respondent and entrust the same to the third Respondent for investigation of the case by a competent officer and file a final report before the concerned jurisdictional Magistrate within the time stipulated by this Court.
ORDER:- This Criminal Miscellaneous petition is coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr. B.Nambiselvan, Additional Public Prosecutor for the Petitioners this Court made the following order: This petition has been filed to extend the time of three months to complete the investigation and to file a final report before the jurisdictional Court. 2.The learned Additional Public Prosecutor appearing for the petitioners submitted that 7 witnesses have been examined so far and hence, he seeks three 2/4
months time to file a final report before the jurisdictional Magistrate Court. 3.Considering the above submission, the (*)nominated Deputy Superintendent of Police is directed to complete the investigation and file final report in Crime No.319 of 2021 before the jurisdictional Magistrate Court, within a period of three months from the date of receipt of a copy of this order. 4.Accordingly, this Criminal Miscellaneous Petition is allowed. (*)The learned counsel for the original petition submitted that now the closure report has been filed before the concerned Court. Liberty is also granted to the petitioner to workout his remedy through appropriate proceedings.
