ORDER : The Court Made the following order :- Apprehending arrest at the hands of the respondent police for the alleged offences punishable under Sections 120(b), 294(b), 406, 420 and 506(ii) IPC in Crime No.748 of 2015 on the file of the respondent police, the petitioners have come forward with this petition seeking anticipatory bail.

Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondent police.

The case of the prosecution is that the defacto complainant is said to have paid Rs.60,00,000/- on various dates to A3 for securing admission in M.D. Dermatology Course in Sri Sidhartha Medical College University, Thumkoor, Bangalore and A3 was introduced by these petitioners and subsequently, they neither secured a seat nor returned the amount.
4. Learned Government Advocate (Crl. Side) submitted that on the false promise of securing M.D. Seat, these petitioners along with other accused swindled amount of the defacto complainant and investigation of the case is pending.

5. Learned counsel for the petitioners has submitted that the amount received has been paid to the College in which the defacto complainant wanted admission, which is refuted by the Intervenor stating that no amount has been remitted into the college account.
6. Taking note of the serious nature of the offences alleged against these petitioners and also considering the fact that there is no change in fact situation, this Court is not inclined to grant anticipatory bail to the petitioners.
