ORDER : The Court Made the following order :- The learned Counsel for the petitioner would submit that the petitioner is in judicial custody for more than 80 days and final report has not been filed.

2. It is also submitted by the learned Government Advocate (Crl.Side) on verification that charge sheet is yet to be filed.

At this juncture, the learned counsel for the petitioner seeks permission of this Court to withdraw the petition and to file a petition under Section 167(ii) of Cr.P.C before the trial court and he submits that due to pendency of the above petition, he is unable to file the statutory bail application before the trial court.
