For Respondent : Mr.K.Dinesh Babu, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 39 of 2021 on the file of the respondent Police ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 148, 294(b), 324, 307 and 506(2) IPC in Crime No.39 of 2021, seeks anticipatory bail.

2.The case of the prosecution is that the defacto complainant is working as a supplier in TASMAC No.4719 and on 03.02.2021 at night hours, the petitioner and his friends came there for having liquor. After finishing drinking, when the defacto complainant asked payment for the liquor, the petitioner and other accused abused the defacto complainant in filthy language and attacked him with aruval, due to which, the defacto complainant suffered injuries. Hence, the complaint.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he did not commit any offence as alleged by the prosecution.

4.The learned Additional Public Prosecutor appearing for the respondent police submitted that the petitioner is having six previous cases and that the co-accused were arrested and they are still in custody.

5.Considering the nature of the offence and the fact that the petitioner is having six previous cases, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed.
