PRAYER:

Civil Revision Petition filed under Article 227 of Constitution of India to direct the learned District Munsif, Tiruchirappalli to dispose the suit in O.S.No.445 of 2015, within a stipulated time.

ORDER

This Civil Revision Petition has been filed by the revision petitioner to direct the District Munsif, Tiruchirappalli to dispose of the O.S.No.445 of 2015, within a stipulated time. 2.Heard the learned counsel appearing for the petitioner and perused the materials available on record.

3.Perusal of 'B' Diary shows that PW1 has filed proof affidavit only on 12.08.2021. PW1 was absent on the next hearing date and the learned counsel for the defendant reported "no instructions". The Court below sent notice to the defendant and the learned counsel appearing for the defendant filed vakalat on 22.12.2021. From 22.12.2021 to 11.01.2022, as per instructions issued by the High Court, Court functioning was restricted. On 24.02.2022, the case was posted for cross examination of PW1 and on that day, it was reposted to 30.03.2022. The case was adjourned to several hearings, because of the parties.

4. Since the suit is pending from the year 2015, both the parties are directed to co-operate for disposal of the suit before the Court below and the learned District Munsif, Tiruchirappalli is directed to dispose of the matter within four months, from the date of receipt of a copy of this order.
