Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus directing the respondent No.1 to conclude the disciplinary action initiated against the petitioner in pursuance to the charge memo issued by the respondent No.2 vide Na.Ka.No.4931-/A5-2013 dated 25.09.2015 within the time period stipulated by this Court.

ORDER
This Writ Petition has been filed seeking a Writ of Mandamus, directing the first respondent to conclude the disciplinary action initiated against the petitioner in pursuance to the charge memo issued by the second respondent vide Na.Ka.No.4931-/A5-2013 dated 25.09.2015 within the time period stipulated by this Court.
2. Heard the learned counsel on either side.
3. The petitioner is working as a 'Superintendent' in the second respondent office. When the petitioner was serving as Superintendent at Government Primary Health Centre, Peraiyur, Paramakudi, he was served with a charge memo dated 25.09.2015 pursuant to the audit objection and thereafter, no steps have been taken for clearing such audit objection. The petitioner submitted his explanation to the said charge memo on 13.01.2016 and 18.02.2016 and based on the same, the second respondent had dropped further action against the petitioner vide proceedings in Proc.R.o.4931/A4/2013 dated 31.12.2020, which was suo motu set aside by the first respondent vide order in R.No. 55822/DA/S1/2021 dated 29.06.2021 for the reason that the disciplinary 2/4
authority is the first respondent and therefore, he has to take a suo motu revision. Hence, the petitioner came before this Court seeking the aforesaid relief.

Considering the limited scope of the relief sought by the petitioner in this writ petition, this Court directs the first respondent to conclude the enquiry, pursuant to the disciplinary action initiated against the petitioner in the charge memo issued by the second respondent vide Na.Ka.No.4931-/A5-2013 dated 25.09.2015 within a period of three months from the date of receipt of a copy of this order.
5. With the above direction, this writ petition is disposed of. No costs.
