This Criminal Miscellaneous Petition filed under Section 582 BNSS praying to permit the petitioner herein to withdraw the amount of Rs.1,56,000/- which has been deposited by the respondent herein as per the order of the Principal District and Sessions Court, Srivilliputhur vide order made in Crl.M.P.No.3806 of 2022 dated 09.11.2022 and as per the order of this Court made in Crl.M.P.(MD)No.1265 of 2025 dated 30.01.2025 which is lying to the credit of C.C.No.280 of 2021 on the file of the Fast Track Judicial Magistrate Court, Srivilliputhur, pending disposal of the above criminal revision.

ORDER

The above petition has been filed seeking permission to withdraw the amount of Rs.1,56,000/- that came to be deposited by the respondent. 1/3

2. Heard the learned counsel on either side.

3. The learned counsel appearing for the petitioner would submit that the respondent has deposited sum of Rs.78,000/- after the order of the appellate Court while suspending the sentence and again Rs.78,000/- before the trial Court as per the directions of this Court and that the petitioner may be permitted to withdraw the said amount.

4. The learned counsel appearing for the respondent would submit that the matter may be referred to mediation and he has not raised any objections with regard to withdrawal of the amount.

5. Considering the above, the petitioner is permitted to withdraw the amount that was deposited by the respondent before the Court below on giving necessary undertakings.
