Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- Apprehending arrest at the hands of the respondent police for the alleged offences punishable under Sections 120(B), 406 and 420 IPC in Crime No.624 of 2016 on the file of the respondent police, the petitioner/A1 has come forward with this petition, seeking anticipatory bail.

Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondent police.

The case of the prosecution is that this petitioner along with other accused is alleged to have swindled the funds allotted by the Government for 100 days employment scheme and Old Age Pension Scheme by obtaining the salary and pension of death persons, showing as if they were alive from 01.08.2015 to 23.10.2016, which resulted in registration of the case. 4.

Learned Government Advocate (Crl.Side) submitted that the accused persons misappropriated the amount to the tune of Rs.25,00,000/- and the investigation of the case is pending.

5. Learned counsel for the petitioner would submit that in order to identify the exact beneficiary and disburse the amount, Biometric System has been introduced and the same is still in existence and therefore, there is no truth in the allegation levelled against the petitioner.

6. Taking note of the serious nature of the offences alleged to have been committed by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
