Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus, directing the 2nd respondent to conduct enquiry and issue Patta in petitioner's name, on the basis of his representation sent to the 1st respondent on 05.12.2025 within time stipulated by this Court.
ORDER
The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the 2nd respondent to conduct enquiry and issue Patta in petitioner's name, on the basis of his representation sent to the 1st respondent on 05.12.2025 within time stipulated by this Court. 2.The petitioner has purchased the property from the 3rd respondent's father. After purchase, the petitioner has not taken steps to mutate the revenue records and now the petitioner is https://www.mhc.tn.gov.in/judis
seeking to execute a Will in the name of in the name of the petitioner's children. However, when it was verified, it is seen that the revenue records were mutated in the name of the third respondent, who is the son of the petitioner's vendor. Therefore, the petitioner is seeking to consider the petitioner's representation dated 05.12.2025 and conduct an enquiry and issue Patta in the petitioner's name.
3.The learned Additional Government Pleader appearing for respondents 1 and 2 submitted that already notice was issued to the petitioner and the third respondent and the proceedings have been initiated. The said submission is recorded. 4.The second respondent shall conduct an enquiry and pass appropriate orders in accordance to law after giving opportunity to the rival parties. The said exercise shall be completed within a period of eight weeks from the date of receipt of a copy of this order. 5.With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
