ORDER : The Court made the following order :- The petitioners / Accused, who were arrested and remanded to judicial custody on 13.02.2025 for the offences punishable under Sections 406, 420, 120(B) IPC and 14, 4(1) and 76(1) of the Chit Funds Act in Crime No.1 of 2025, on the file of the respondent police, seeks bail.
2. Taking into consideration of the facts and circumstances of the case and also considering the period of incarceration suffered by the petitioner, this Court has already granted interim bail to the petitioners vide order, dated 26.03.2025.
3. The learned Counsel appearing for the petitioners submitted that the petitioners have already executed bond and sureties and submitted the same before the Trial Court, based on the earlier order, dated 26.03.2025.
4. The learned Additional Public Prosecutor for the respondent police 2/5
has stated that the petitioners have made payments for 41 persons out of the 48 victims. However, due to financial constraints, the petitioners were unable to pay the amount for the remaining 7 victims.
5. Taking into consideration of the facts and circumstances, this Court is inclined to grant bail to the petitioners. Consequently, the interim bail already granted by this Court on 26.03.2025 in Crl.O.P(MD).No.5067 of 2025 is made absolute. The sureties already provided before the Trial Court will continue to be valid, subject to the following additional conditions:
a) the petitioners are directed to deposit a sum of Rs.2,00,000/- (Rupees Two Lakhs only) to the credit of Crime No.1 of 2025 on the file of the Judicial Magistrate, Uthamapalayam on or before 27.02.2026 failing which the bail granted to the petitioners shall stand vacated automatically. The balance amount shall be paid within a period of six months thereafter. On such deposit, the balance 7 victims are permitted to withdraw their amount after producing the appropriate evidence. b) the other conditions except 9(i) imposed by this Court vide 3/5
order, dated 26.03.2025 remain un altered.
