For Respondent : Mr.R.Sivakumar, Government Advocate (Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Section 438 of Cr.P.C. PRAYER :-For Anticipatory Bail in Crime No.202 of 2022 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioner/sole accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 379 IPC and Section 21(4) of Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.202 of 2022, on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that on 06.04.2022, the petitioner has illegally transported 1 unit of river sand. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. However, he would further submit that the petitioner, without prejudice to his right, is ready to deposit the amount that may be imposed by this Court.

CRL OP(MD). No.7231 of 2022 4.The learned Government Advocate (Criminal Side) appearing for the respondent police would submit that the petitioner has transported 1 unit of river sand illegally. He would further submit that the petitioner is having seven previous cases for the similar offence and all the cases were relating to river sand. 5.Considering the seriousness and gravity of the offence alleged against the petitioner and also the fact that the petitioner is having seven previous cases, this Court is not inclined to grant anticipatory bail to the petitioner.
