Heard Mr.M.AnanthKumar for the petitioners and Mr.I.Murugesan, learned Government Advocate (Criminal Side) for the Respondent. 1/5
2. This Criminal Miscellaneous Petition has been filed to modify the condition No.6(b) mentioned in the order dated 05.01.2026 made in Crl.O.P. (MD)No.23658 of 2025.
3. The Co-ordinate Bench of this Court, by order dated 05.01.2026, granted bail subject to, inter alia, the following condition: "6.
.......
(b) the first petitioner is directed to deposit a sum of Rs.50,000/- (Rupees Fifty Thousand only) and the second petitioner shall deposit a sum of Rs.20,000/- (Rupees Twenty Thousand only), to the credit of Crime No.4 of 2018 before the learned Judicial Magistrate No.II. Thanjavur. After receipt of entire amount, the learned Judicial Magistrate, shall deposit the said amount in an interest bearing Fixed Deposit in any Nationalized Bank initially for a period of one year and renew them periodically until the final order/Judgment is passed in the case in Crime No.4 of 2018. The learned Judicial Magistrate or Trial Court shall pass orders regarding entitlement of the said amount in its final order/Judgment"

Today, when the matter is taken up for hearing, the learned counsel for the petitioners seeks modification of the condition in paragraph 6(b) imposed on the petitioners on the ground that the 1st petitioner is a senior citizen and the 2nd petitioner, who earns her livelihood by doing household chores in neighbouring houses, has no means to deposit the amount directed by this Court.
5. On a perusal of the order, it is seen that the learned Judge, after considering the merits of the case and the amount involved in the alleged cheating, granted bail subject to certain conditions.
6. Hence, this Court is not inclined to modify the condition imposed on the petitioner in Crl.O.P.No.23658 of 2025, by order dated 05.01.2026. However, the time granted to comply with the said condition, namely six weeks, is hereby extended by a further period of 10 days from the date of receipt of a copy of this order. The other conditions imposed by the Co-ordinate Bench of this Court shall remain unaltered.

7. In view of the above, this Criminal Miscellaneous Petition stands dismissed.
