ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorari, to quash the impugned order in Na.Ka.No.4221/Vo/2023 dated 08.07.2024 issued by the 1st respondent. 2.The respondent has passed the impugned order under Section 68 of the Registration Act read with the Circular. The said Section and Circular has already been held as null and void. And the power granted under Section 77A has already been struck down. Therefore, the first respondent has no power to conduct such enquiry. In the present case, there is no question of impersonation. Therefore, there is no question of conducting any enquiry under Section 83 of the Registration Act. If the second respondent is aggrieved against any transaction alleged to have been created by the petitioner, he is at liberty to file a civil suit to get any remedy before the Civil Court. Therefore, the impugned order is quashed.

3. With the above observations, this Writ Petition is allowed. 2/4

There shall be no order as to costs.
