ORDER

The present application has been filed seeking to quash the FIR in Crime No. 864 of 2025 on the file of the first respondent Police against the petitioner for the offences under Sections 296(b) and 109(1) of BNS, 2023. 2.A perusal of the FIR reveals that a specific overt act is alleged against the petitioner. It further reveals that he is alleged to have attacked a passenger of the bus with a wooden log and caused serious head injuries. 3.According to the learned counsel appearing for the petitioner, there is no previous enmity between the petitioner and the defacto complainant, and therefore, there is no reason whatsoever for attacking the defacto complainant. 4.Heard the learned counsel on either side and perused the materials available on records.

5.Since specific overt acts are alleged against the petitioner, at this stage of the investigation, this Court is not inclined to interfere with the investigation process, and there are no merits in this petition. 2/4

6.With the above observations, this Criminal Original Petition stands dismissed. Consequently, the connected Criminal Miscellaneous Petition stands closed.
