2. Heard the learned counsel for the petitioner and the learned counsel appearing for the first respondent.

3. Though notice was served on the second respondent and his name is also printed in the cause list, there is appearance on behalf of the second respondent.

4. Being satisfied with the reasons stated in the accompanying affidavit, the delay of 9 days is condoned and the petition is ordered.
