ORDER

This Writ Petition has been filed to issue a Writ of Mandamus directing the respondent to make payment of gratuity and leave encashment amount and remaining salary for the suspension period from 04.03.2011 to 31.05.2012.

2. The case of the petitioner is that he was initially appointed as Forester during the year 1981 and subsequently, he was promoted as Forest Ranger and joined in the Melsengam Range on 29.03.2010. Later, on 20.10.2010, he was transferred and posted as Ranger to Panruti Range and there was an auction conducted by the Regional Manager on 02.03.2011, in which, many contractors assembled and started remitting the E.M.D amount to him and after counting the same, when he made entries in the E.M.D register, a false trap was laid and thus, he was made an accused on the same. As such, he was placed under suspension on 04.03.2011 and https://hcservices.ecourts.gov.in/hcservices/

subsequently, he was retired from service on 31.05.2012 without getting any retirement benefits, because of which, the family of the petitioner's put into hardship and hence, the petitioner has sent a representation dated 07.07.2014 to the respondents. In such circumstances, the petitioner has filed the present Writ Petition.

3. Today, when the matter was taken up for hearing, the learned counsel appearing for the respondent would submit that already the petitioner has been paid with all the retirement benefits. The learned counsel appearing for the petitioner has also agreed with the same.

As such, both parties, on instructions, would submit that the matter has become infructuous.

4. Recording the said submission, the Writ Petition is dismissed as infructuous. No costs.
