ORDER

The petition is for a direction to the first respondent to withdraw the case in Crime No.8 of 2015, on the file of the respondent No.3 and transfer the same to Respondent No.2.

2. The learned counsel for the petitioner pointed out that the allegation in the First Information Report in Crime No. 8 of 2015, require investigation by the C.B.C.I.D (Cyber Cell). In this case, a First Information Report was registered for the offences punishable under Sections 406 and 420 IPC, on 10.02.2015.

3. The allegation is that under the false information, the petitioner was made to deposit a huge sum nearly about Rs.9,00,000/- by the accused through some dealings via internet. Since, there was no progress in the criminal case registered, the petitioner approached this Court seeking specific direction. https://hcservices.ecourts.gov.in/hcservices/

4. At the direction of this Court, the first respondent has filed the status report on 18.07.2017, before this Court. In the status report, it has been stated that after getting legal opinion, the first respondent is instructed to further investigate the case with the help of C.B.C.I.D. (Cyber Cell), if required.

5. It is further submitted that as per the direction of the first respondent, further investigation is in progress and the third respondent seeking only six months time to complete the entire enquiry and file a final report in Crime No. 8 of 2015.

6. Recording the said statement, this Criminal Original petition is disposed of. However a direction is issued to the third respondent to complete the investigation and file a final report in Crime No.8 of 2015 within a period of four months from the date of receipt of a copy of this order.
