ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 316(2) and 318(4) of BNS, in Crime No.55 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the defact complainant mortgage his lorry bearing Registration No.TN58AT 6485 and received a sum of Rs.1,00,000/- from A1. And after 9 months, the defacto complainant returned the said amount and asked A1 to return his lorry. But, A1 did not return the lorry and told that lorry is with A2 and A3. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he is no way connected with the alleged occurrence as stated by the prosecution. He further submitted that the petitioner is ready and willing to abide by any conditions that may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioner. 2/4

4. The learned Government Advocate (Crl. side) submitted that the investigation is almost completed and there are no previous cases pending against the petitioner. However, he opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration of the facts and circumstances of the case, on earlier hearing, this Court has directed the petitioner to deposit some amount to the credit of the crime number for considering this petition. Today, the learned counsel expressed his difficulty to deposit the amount. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
