Petition is filed under Article 226 of the Constitution of India for the issue of a Writ of Mandamus, directing the first respondent i.e. The Agricultural Production Commissioner and Principal Secretary to Government, Chennai to dispose off the disciplinary action initiated in memo NO. DCS2/5657/13 dated 06.01.2014 of the Commissioner of Horticulture and Plantation Crops, Chennai on merits and in accordance with law within a specified time frame that may be fixed by this Court.

ORDER

The prayer in the Writ Petition is a Writ of Mandamus praying to direct the first respondent i.e. The Agricultural Production Commissioner and Principal Secretary to Government, Chennai to dispose off the disciplinary action initiated in memo NO. DCS2/5657/13 dated 06.01.2014 of the Commissioner of Horticulture and Plantation Crops Chennai on merits and in accordance with law within a specified time frame that may be fixed by this Court. 2.Mr.R.Velmurugan, the learned Government Advocate takes notice for the respondents and by consent of both parties, the writ petition itself is taken up for final disposal. 3.The learned Counsel appearing on behalf of the petitioner submitted that it would suffice if the disciplinary action initiated against the petitioner is disposed of, on merits and in accordance with law, within a time frame to be fixed by this Court. https://hcservices.ecourts.gov.in/hcservices/

4.In view of the limited scope of the prayer, without expressing any opinion on the merits of the issue involved, the first respondent is directed to complete the enquiry proceedings and pass appropriate orders in the disciplinary proceedings in memo No.DCS2/5657/13, dated 06.01.2014, if not already disposed of, and pass appropriate orders on the same on merits and in accordance with law, within a period of three months from the date of receipt of a copy of this order, after affording the petitioner an opportunity of being heard.

5.With the above direction, this Writ Petition stands disposed of. No costs.
