ORDER
(Order of the Court was made by G.R.Swaminathan J.) Vide order dated 28.02.2023, the Hon'ble Division Bench in W.P(MD)No.4076 of 2023 had directed the Tahsildar, Kadaladi to remove the encroachments in question. Two persons, namely, Lakshmi and Mariyammal, had put up as many as 25 shops right outside a temple compound wall. The Tahsildar passed eviction orders under Section 6 of the Land Encroachment Act, 1905. Aggrieved by the same, both the encroachers filed appeals before the District Collector, Ramanathapuram. The District Collector had dismissed the appeals on 20.11.2025. Aggrieved by the same, Lakshmi filed W.P(MD)No.35749 of 2025. The Hon'ble Division Bench dismissed the writ petition on 15.12.2025 and imposed costs of Rs.25,000/- (Rupees Twenty Five Thousand only). Mariyammal preferred revision petition before the Government and it is still pending. Since Lakshmi's writ petition has been dismissed, nothing stops the authorities from demolishing the shops put up by her. 2/4
2.We direct the Tahsildar, Kadaladi to demolish the shops constructed by Lakshmi. We also direct the Government to dispose of the revision petition filed by Mariyammal within a period of four months from the date of receipt of a copy of this order. The Tahsildar, Kadaladi shall take further steps based on the outcome of the said revision petition. 3.This Contempt Petition is disposed of accordingly.
