ORDER : The Court Made the following order :- The petitioner, who is arrayed as Accused No.5, in Crime No.171 of 2017 on the file of the respondent police, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 147 I.P.C read with Section 3 of TNPPDL Act and hence, seeks anticipatory bail.

2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent/State. 3.The case of the prosecution is that all the accused in this case are said to have damaged the stone inscription of the church to continue the names of the donars.

4.The learned counsel appearing for the petitioner submitted that the petitioner is the Government employee and at the time of occurrence, the petitioner was not involved in the alleged occurrence and the petitioner has been falsely implicated in this case.

5.The learned Additional Public Prosecutor appearing for the respondent, on instructions, submitted that totally there are six accused in this case and all the accused are named in the F.I.R and the defacto complainant is the pastor of the Church. He would further submit that A.1 to A.4 were arrested and they are in https://hcservices.ecourts.gov.in/hcservices/

judicial custody; A.6 is still absconding and the petitioner herein is arrayed as A.5 in this case and the investigation is still pending.

6.Considering the above facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Alangulam and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously. 7.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
