Prayer :- Criminal Original Petition filed under section 482 of Cr.p.c To direct the Learned Judicial Magistrate Aruppukottai Virudhunagar District to dispose the C.C No. 52/2015 within the tiem may be fixed by this Honourable Court. ORDER:- This Criminal Original Petition coming on for hearing on this day in the caption for "Extension of time" and upon hearing the arguments of M/s.P.Sepana @ Sree Advocate for the Petitioner and of Mr.K.Suyambulinga Bharathi Advocate for the 1st Respondent,This Petition and upon perusing the earlier order of this court 1/4
dated 27.04.2021, and the requisition letter submitted by the Judicial Magistrate No.II, Virudhunaagar vide the letter in D.No.15 / 2022 dated 04.01.2024, this Court made the following order:
"This Court vide orders dated 27.04.2021 directed the learned Judicial Magistrate, Aruppukottai, Virudhunagar District to conclude the trial proceedings and dispose of C.C.No.52 of 2015 on merits within a period of six months from the date of receipt of a copy of that order.
2. The learned Judicial Magistrate No.II, Virudhunagar vide a letter dated 04.01.2024 bearing D.No.15 has stated that this Court vide orders dated 21.02.2022 in Crl.O.P.(MD) No.20616 of 2021 transferred the case in C.C.No.52 of 2015 on the file of the Judicial Magistrate Court, Aruppukottai to the file of the Judicial Magistrate Court No.II, Virudhunagar with a direction to dispose of the case within a period of 3 months from the date of receipt of papers from the Judicial Magistrate Court, Aruppukottai and the case in C.C.No.52 of 2015 was re-numbered as C.C.No.108 of 2022. She has also sought for extension of time of three months to 2/4
dispose of case in C.C.No.108 of 2022 (C.C.No.52 of 2015).
3. Being satisfied with the reasons stated by the learned Judicial Magistrate No.II, Virudhunagar in the said letter dated 04.01.2024, this Court is inclined to extend the time to dispose of the case in C.C.No.108 of 2022 (C.C.No.52 of 2015). The learned Judicial Magistrate No.II, Virudhunagar is directed to dispose of the case in C.C.No.108 of 2022 (C.C.No.52 of 2015) as expeditiously as possible."
