Respondents Prayer : Criminal Original Petition is filed under Section 482 of Criminal Procedure Code, to direct the respondent Nos.1 to 3 to give adequate police protection to the petitioner and her members for life threat and fencing the petitioner's purchased land with remove the encroachment made by the fourth respondent in Survey No.2/1B, to the extent of 0.43.5 (1 Acres 7 cents) in Thiruppachethi South Group, Thiruppuvanam Taluk, Sivaagangai District based on the petitioner's complaint on 03.04.2021. Subsequently, representation on 17.04.2021.

ORDER

This Criminal Original Petition is filed seeking a direction to the respondents 1 to 3 to give adequate police protection.

2. The petitioner had purchased a land in S.No.2/B, to an extent of 0.43.5 hectare (a acre 7 cents) in Thiruppachethi South 1/3

Group, Thiruppuvanam Taluk, Sivagangai District from one Pakiyam son of Madasamy. On 03.04.2021, he started to put up fencing in the purchased land, but it was interfered by the fourth respondent. Hence the petitioner by his persons gave a complaint on 03.04.2021 to the third respondent Police Station. Thereafter, on 16.04.2021, the fourth respondent has illegally trespassed the petitioner's purchased land without any rights with the help of his henchmen. Hence, the petitioner has sent a detailed representation on 17.04.2021 to the officials of the respondents seeking protection to the petitioner and his members so as to enable them to put up fencing on the petitioner's land and also to remove the encroachment made by the fourth respondent. But it was not considered. Hence this petition.

3. The learned Additional Public Prosecutor would submit that on 23.04.2021, enquiry was conducted, based upon the complaint given by the petitioner and closed, with a direction to work out remedy the civil proceedings.

4. Recording the submission made by the learned Additional Public Prosecutor, nothing survives for further direction or consideration and hence, this Criminal Original Petition stands disposed of, with liberty to approach Civil Court to remedy.
