PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the 1st and 2nd respondents to survey the petitioner's property in Natham S.No.82/39 to an extent of 0-2.07 Hector respectively situated in Karai Village, Devakottai Taluk, Sivagangai District and to install the boundaries stones as per revenue records by obtaining adequate police protection from the 3rd respondent police within the period that may be stipulated by this Court.

O R D E R

This petition has been filed seeking to direct the 1st and 2nd respondents to survey the petitioner's property in Natham S.No.82/39 to an extent of 0-2.07 Hector respectively situated in Karai Village, Devakottai Taluk, Sivagangai District and to install the boundaries stones as per revenue records by 2/7

obtaining adequate police protection from the 3rd respondent police within the period that may be stipulated by this Court.

2. This Court suo-motu impleads The Inspector of Police, Velayuthapattinam Police Station, Karaikudi, Sivagangai District, as the fourth respondent.

The learned counsel appearing for the petitioner submitted that the property in Natham S.No. 82/39, measuring an extent of 0.2.07 hectares, belongs to the petitioner's father based on long-standing possession, and that a separate Natham Patta No. 342 had been issued in his name. On 25.10.2009, the petitioner's father died intestate. After his demise, the petitioner and his siblings have been in peaceful possession and enjoyment of the property. Therefore, the petitioner has submitted an online application seeking to have the land surveyed.

4. Heard the learned Special Government Pleader appearing for the respondents 1 and 2 and the learned Government Advocate (Crl.Side) appearing for the respondents 3 and 4.

Considering the facts and circumstances of the case, this Court directs the 1st respondent to conduct the survey with the assistance of the second respondent after issuing notice to the petitioner as well as the siblings of the petitioner If necessary, seek police protection, the 4th respondent shall provide police protection to survey the land. The Court is also directing the Official respondents to adhere to the following Standard Operating Procedures: a. The Official respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey.

b. After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction.

c. If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest. 4/7

The aforesaid procedure shall be strictly followed by the parties The said exercise shall be completed within a period of 12 weeks from the date of receipt of a copy of this order.
