PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondents 1 to 4 to take appropriate action against the respondents 5 to 21 and prohibit them from encroaching and making construction upon the land in Old S.No.291 and New Survey Nos.288/2, 288/3 and 288/4 situated at Nondichikulam area of Kodikulam Panchayat, Manamelkudi Taluk, Pudukkottai District. ORDER
The prayer sought for in this writ petition for issuance of Writ of Mandamus, directing the respondents 1 to 4 to take appropriate action against the respondents 5 to 21 and prohibit them from encroaching and making construction upon the land in Old S.No.291 and New Survey Nos.288/2, 288/3 and 288/4, situated at Nondichikulam area of Kodikulam Panchayat, Manamelkudi Taluk,
2. Heard Mr.M.Saravanakumar, learned counsel for the petitioner, Mr.C.Selvaraj, learned Special Government Pleader for the respondents 1 to 4 and Mr.M.Suresh, learned counsel for the respondents 6 to 12, respondents 14 to 19 and respondent 21.
3. It is submitted by the learned counsel for the respondents 6 to 12 that in respect of the same survey numbers, another writ petition, W.P.(MD)No.12847 of 2017, was filed with the same prayer before this Court and in that writ petition, the Division Bench, by an order dated 01.08.2017, directed the private respondents to produce all the revenue records before the Tahsildar to take further action in accordance with law.
4. In view of the above submission, there is no further adjudication necessary in this writ petition. Hence, this writ petition is closed. No costs. Consequently, the connected miscellaneous petition is closed.
