Respondents Prayer: Writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 3 to remove the encroachment made by the respondents 4 to 16 and others in Echikulam pond in survey Nos.38 and 39 Eechanviduthi Village, Karambakudi Taluk, Pudukkottai District and in Vembankudi Kulam in survey No.13 in Kurubivayal Village, Karambakudi Taluk, Pudukkottai District by considering the petitioner's representation dated 16.01.2026 in accordance with law within the time stipulated by this Court.

Heard the learned counsel appearing for the writ petitioner and the learned Additional Government Pleader appearing for respondents 1 to 3.

2. Issuance of notice to the private respondents is dispensed with.
3. The writ petitioner is a resident of Panaivaiyal Village in Karambakudi Taluk. He alleges that in the petition mentioned water bodies, there are encroachments and that they have to be cleared. 4.It is seen that the Assistant Engineer, Water Resources Department, Kallanai Channel had already written a letter dated 26.11.2025 calling upon the Tahsildar, Karambakudi to conduct survey of the petition mentioned water bodies.
5. It is seen from the extract of " A " Register that survey No.38 as well as survey No.39 have been classified as tanks.
6. We direct the Tahsildar, Karambakudi Taluk to issue notices to all the interested persons including the named private respondents herein and conduct survey. Based on the outcome of the survey results, Form-I notices will be issued. Thereafter, it is for the concerned authority of the Water Resources Department to take 3/5
4 W.P.(MD)NO.7069 OF 2026 further action. In any event, the petition mentioned water bodies shall be restored to their original condition. This exercise shall be carried out within a period of six months from the date of receipt of a copy of this order. This writ petition stands disposed of accordingly. No costs.
