Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct respondents 1 to 4 to remove the encroachment made by respondents 7 to 11, in S.No.48/5 situated at Melilambana Puridam, Choozhal Dasam, Kollankodu Village, Kanyakumari District, for an extent of 1012 sq.ft (187.5 Sq.Ft in Portion No.2 and 825 Sq.feet (length 55 links and breadth 15 links) in portion No.3, totally 1012 Sq.feet) and to restore the Iron Gate and compound wall in original position in Portion No.3 in the expense of respondents 7 to 11 on the basis of the petitioner's representation dated 20.12.2022, within a stipulated time as may be fixed by this Court.

[Order of the Court was made by S.M.SUBRAMANIAM, J.] The writ on hand has been instituted to direct respondents 1 to 4 to remove the encroachment made by respondents 7 to 11 in S.No. 2/5

2. The learned Additional Government Pleader appearing on behalf of respondents 1 to 4, on instructions, would submit that the subject property in S.No.48/5 is a patta land and the dispute is between the petitioner and his own brother.

3. In view of the submission made by the learned Additional Government Pleader, this Writ Petition stands disposed of granting liberty to the petitioner to approach the competent civil Court of law for the purpose of redressal of his grievances in the manner known to law. There shall be no order as to costs. Consequently, connected miscellaneous petitions are closed.
