ORDER : The Court made the following order :- The petitioners, who were arrested and remanded to judicial custody on 28.01.2026 in connection with Crime No.61 of 2026 on the file of the respondent police for the offences punishable under Section 303(2) of the Bharatiya Nyaya Sanhita, 2023, seek bail.

2. The case of the prosecution is that on 28.01.2026, between 04.30 a.m. and 06.00 a.m., during the marriage of the defacto complainant's relatives, while the collection of "moi" was taking place, at about 08.30 a.m., the petitioners allegedly committed theft of a sum of Rs.10,000/- from the marriage party. Hence, the respondent police registered a case against the four accused persons for the aforesaid offences.

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and has not committed any offence as alleged by the prosecution. He further submitted that the petitioner will abide by any conditions that may be imposed by this Court. Hence, he prayed for the grant of bail.

4. The learned Additional Public Prosecutor submitted that the petitioners are habitual offenders and that several cases of a similar nature are pending against them. He further submitted that they have been indulging in such offences in various places and that the investigation is still pending. Hence, he strongly opposed the grant of bail to the petitioners.

5. This Court heard the learned counsel appearing on either side and perused the materials placed on record.

6. Considering the nature of the allegations, the modus operandi adopted by the petitioners, their involvement in similar offences, and also taking into account the stage of investigation, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
