O R D E R

This Criminal Original petition is filed seeking a suitable direction to the learned Judicial Magistrate No.1, Thoothukudi, for speedy disposal of the criminal case in C.C.No.495 of 2006 within the time stipulated by this Court.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Criminal side) appearing for the respondent.

3. The case of the petitioner is that the respondent police registered a case in Crime No.483 of 2006 against the petitioner for the alleged offences under Section 304(A) of I.P.C., based on the complaint given by one Cabrial Karuppasamy. Pursuant to the complaint, the respondent police without conducting proper investigation, filed charge sheet in the above crime number and the same was taken on file in C.C.No.495 of 2006 on the file of the learned Judicial Magistrate No.I, Thoothukudi, even though the petitioner is no way connected with the alleged commission of https://hcservices.ecourts.gov.in/hcservices/

offences. In the said circumstances, this petition has been filed.

4. The learned Government Advocate(Criminal side) on instructions submitted that the trial Court may be directed to dispose of the above criminal case within a period of three months.

5. Hence, the Criminal Original petition is allowed. The learned Judicial Magistrate No.1, Thoothukudi, is directed to dispose of the criminal case in C.C.No.495 of 2006 within a period of the three months from the date of receipt of a copy of this order.
