*********** This writ petition has been filed for a Mandamus seeking for a direction to the respondents 4 and 5 to delete and remove the wrong entries made in Patta No.605 on the file of the fourth respondent in respect of Survey No.83/14 at Thathaneri Village, Madurai North Taluk, Madurai District and mutate the revenue patta in respect of survey No.83/14 at Thathaneri Village, Madurai North Taluk, Madurai District in the name of the petitioner, within a time frame to be fixed by this Court.
2.According to the petitioner, there are wrong entries in Patta No.605 issued by the fourth respondent. In such circumstances, the petitioner has given a representation on 21.02.2022, seeking for rectification of the error. Since the said representation has not been considered till date, the petitioner has filed this writ petition.
3.Heard Mr.Mahaboob Fazil for Mr.T.Lajapathi Roy, learned Counsel appearing for the writ petitioner and Mr.D.Sasikumar, learned Additional Government Pleader who accepts notice on behalf of the respondents.
4.No prejudice would be caused to the fourth respondent if the petitioner's representation is considered on merits and in accordance with law after affording a fair hearing to the petitioner and any other necessary party whom the fourth respondent deems fit to enquire. The petitioner has filed documents in support of his contentions along with this writ petition. It is for the fourth respondent to consider the same on merits and thereafter decide as to whether the relief sought for in the petitioner's representation can be granted or not.
5.For the foregoing reasons, this Court directs the fourth respondent to consider the petitioner's representation dated 21.02.2022, requesting for deletion and removal of the wrong entries made in Patta No.605 on the file of the fourth respondent in respect of Survey No.83/14 at Thathaneri Village, Madurai North Taluk, Madurai District and mutate the revenue patta in respect of Survey No.83/14 at Thathaneri Village, Madurai North Taluk, Madurai District, in the name of the petitioner and pass final orders on merits and in accordance with law after affording a fair hearing to the petitioner and any other necessary party whom the fourth respondent deems fit to enquire including granting them the right of personal hearing within a period of twelve [12] weeks from the date of receipt of a copy of this order.
