For Respondent : Mr.P.Kottaichamy, Government Advocate (Crl.Side) ORDER: The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 191(2), 118(1), 133, 351(3) of BNS, 2023, (Sections 147, 324, 355, 506(ii) of IPC) in Crime No.48 of 2026, on the file of the respondent police, seek anticipatory bail.

2.The case of the prosecution is that on 07.08.2025, due to the civil dispute, on 28.02.2026. at about 07.00 a.m, when the complainant and his son were proceeding to their agricultural land through the common pathway, the petitioners are said to have assaulted the defacto complainant and his son with a stick, a broomstick & a knife and caused blood injuries and also threatened them with dire consequences. Hence, the respondent police registered a case against the petitioner for the aforesaid offences. Hence, this petition.

3.The learned counsel appearing for the petitioners submitted that the petitioners have been falsely implicated in this case and they have not committed any offence. He further submitted that it is a case and case in counter and counter has been registered against the complainant in Crime No.46 of 2026 and the injured were only treated as out patient. Hence, he seeks this Court to grant anticipatory bail to the petitioners. 4.The learned Government Advocate (Crl.side) appearing for the respondent strongly opposed to grant anticipatory bail to the petitioner stating that the investigation is still pending. However, he fairly conceded that it is a case and case in counter and the injured were treated as out patient.

5.Considering the facts and circumstances of the case and also considering the fact that it is a case and case in counter and the injured were treated as out patient, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions. 3/6

6.Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, on condition that the petitioners 1 to 4 shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two common sureties each for a like sum to the satisfaction of the learned Magistrate concerned and the petitioners 5 to 8 shall execute a bond for a sum of Rs.

10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the Judicial Magistrate Court, Vadipatti, Madurai, within a period of fifteen days from the date on which the order made ready and on further conditions that: [a]the petitioners and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhaar card or bank pass book to ensure their identity. [b]the petitioners 1, 2, 5, 6, 7 & 8 shall report before the respondent police daily at 10.30 a.m., for a period of 15 days and thereafter, as and when required for interrogation and the petitioners 3 & 4 shall report before the respondent police as and when required for interrogation.

[c]the petitioners shall not tamper with the evidence or witness either during investigation or trial.

[d]the petitioners shall not abscond either during investigation or trial. [e]On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner is released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[f]If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.
