ORDER

This Writ Petition is filed to issue a Writ of Mandamus, directing the second Respondent to conduct an enquiry and take necessary action against the private respondent in the light of the petition forwarded by the first Respondent vide No.HLG/26076903 dated 22.03.2026 and conclude the same within time frame as fixed by this Court.

2. Learned counsel for the petitioner submitted that the third respondent is the paramour of the petitioner's wife. The petitioner had married one Krishnaveni and out of the said wedlock, they were also blessed with a female child, namely Priyadarshini, aged about 4 1/2 years. The said Krishnaveni had developed intimacy with the third respondent and had left out from her matrimonial home deserting the petitioner and is presently living with the third respondent. Due to which the petitioner's father in law, that is the father of the petitioner's wife, husband, petitioner's father in law, that is the father of Krishnaveni, namely Ramakrishnan had lodged a complaint on 10/6/2025, before the 2/5

second respondent police and on enquiry, the second respondent Police had secured the petitioner's wife as well as his child on 19.06.2025. Even thereafter, deserting the petitioner as well as the child, she had ran away with the third respondent. In the interregnum, the third respondent had forcibly entered into the petitioner's house on 21.02.2026 in his absence at about 3:00 pm and had taken away the petitioner's minor daughter. Immediately the petitioner had lodged a complaint to the first respondent on 23.02.2026 and the same was forwarded to the second respondent. However, no action was taken on the petitioner's complaint.

3. The learned Government Advocate submitted that already the petitioner's complaint was enquired and when the child had expressed her reluctance to go with the father.

4. Heard either side and carefully perused the materials available on record.

Advocate, giving liberty to the petitioner to file a Guardian OP, this Writ Petition is disposed of. No costs.
