ORDER

This Criminal Original Petition has been filed for issuing a direction to the 3rd respondent to register a case in respect of complaint made by the petitioner, dated 16.04.2018 on the file of the third respondent Police.

2. According to the petitioner that he has made a complaint before the third respondent against the Thasildar, Kodikanal, for illegally removing the fence from the petitioner's property, but, so far, no action has been taken. Hence, the petitioner has filed the present Criminal Original Petition before this Court.

3. The learned Government Advocate (Crl. Side) appearing of the respondents would submit that the petitioner has already filed W.P(MD).No. 5332 of 2018 before this Court and the same is pending. He further submitted that now the disputed issues have been pending before the Revenue Divisional Officer.

4. In view of the fact that the enquiry is pending before the Revenue Divisional Officer, the petitioner shall work out his appropriate remedy before the Civil Court.

5. With the above observations, this Criminal Original Petition is dismissed.
