RESPONDENT/RESPONDENT Criminal Miscellaneous Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify the condition imposed by this Honble Court in Crl.OP(MD)No.3248/2024 dt.1/3/2024 as (C) the petitioners shall report before the respondent police daily at 10.30 a.m., for a period of two weeks and thereafter, as and when required. Order : This Criminal Miscellaneous Petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of MR.K.ARUNRAJ, Advocate for the petitioner and of MR.P.KOTTAICHAMY, Government Advocate (Criminal Side)on behalf of the Respondent, the court made the following order:- 1/3

On 01.03.2024, this Court granted anticipatory bail to the petitioners to appear before the respondent Police daily at 10.30 A.M., for a period of two weeks and thereafter, as and when required for interrogation. However, it is claimed that the respondent Police insisted the petitioners to execute the bond under Section 110 of Cr.P.C. Therefore, the present Modification Petition is filed.

2. It is impermissible for the respondent Police to direct the petitioners to execute the bond under Section 110 Cr.P.C. The petitioners are directed to appear before the respondent Police from tomorrow onwards (29.03.2024) for a period of two weeks at 10.30 A.M., and thereafter, as and when required for interrogation, failing which, the anticipatory bail granted by this Court shall stand automatically vacated.
