ORDER

The present petition has been filed by the sole accused in Crime No. 617 of 2025 on the file of the first respondent police wherein the petitioner is alleged to have committed the offence under Section 75(1)(c) of Tamil Nadu City Police Act, 1888.

2.A perusal of the FIR reveals that the petitioner is said to have been standing on the road, and he was abusing and threatening the general public, and despite the warning, he was continuing to do the same, and therefore, he was arrested at about 06:15 PM on 04.10.2025.

3. The learned counsel for the petitioner submits that since the petitioner is working in Zomato, he has been falsely implicated by the respondent police.

4. A perusal of Section 75(1)(c) of Tamil Nadu City Police Act, 1888, reveals that the behaviour should be violent, or boisterous, or disorderly or riotious and such behaviour likely to cause breach of public peace.

5. In the present case, no general public has made any complaint to the police officials and there is no allegation in the FIR that it is likely to cause breach of peace.

6. In the said circumstances, this Court is of the considered opinion that the ingredients of Section 75(1)(c) of Tamil Nadu City Police Act, 1888, have not been satisfied.

7. In view of the above said fact, FIR in Crime No.617 of 2025 on the file of the first respondent police stands quashed and the Criminal Original Petition stands allowed. Consequently, the connected miscellaneous petition is closed. 17.03.2026 NCC : Yes/No Index : Yes/No Internet: Yes/No dss To
